10 ESSENTIAL LEASE CONTRACT TIPS FOR TENANTS IN KUWAIT

Signing a lease contract is an important step when renting a property in Kuwait. A lease agreement is not simply a document confirming the monthly rent; it establishes the rights and responsibilities of both the landlord and tenant throughout the tenancy.
For expatriates in particular, understanding the terms and conditions of the lease contract is important because residency arrangements can also be connected to the rental address. Before signing, tenants should take the time to read and understand every clause and make sure that important details are clearly included in the agreement.
Here are some key points that tenants should understand before signing a lease contract in Kuwait.
UNDERSTANDING THE LEASE CONTRACT
Expatriates in Kuwait must have a valid residency permit to rent a property, and keeping the rental agreement valid and current is important for their residency arrangements.
A typical Kuwaiti lease contract outlines the rights and responsibilities of both the landlord and tenant, including the lease duration, renewal terms, rent, payment dates, and other conditions.
Before signing, tenants should ensure that the contract clearly identifies both parties and provides complete property details, including the address, PACI numbers, number of rooms, amenities, tenancy dates, monthly rent, payment method, and due dates.
As a legally enforceable document, every clause should be understood and agreed upon before signing.
Here are 10 important tips every tenant should keep in mind before signing a lease contract in Kuwait:
1) The Security Deposit: A Security Deposit clause specifies the amount of the deposit (ordinarily equivalent to one month’s rent) together with the conditions governing its return. In most cases, the Security Deposit cannot be applied as rent payment for the last month, and the Landlord has the right to withhold the amount necessary to cover the cost of any damages resulting from the negligence of the tenant like damaged cabinets, doors, floor or bathroom tiles, excessive nail marks on the walls etc. While normal wear tear is exempt from deduction, the tenant is expected to take proper care of the Apartment during the course of his stay, and refrain from doing any structural changes without the written approval of the Landlord. It should be noted that, if for any reason, the tenant is not able to complete the initial duration of the lease contract, it will result in the forfeiture of the Security Deposit.
2) Water & Electricity charges: Water and Electricity charges are generally payable by the Landlord, but at some properties the Landlord may prefer that the Tenant bears these charges. In such cases, this should be mentioned in the Lease Contract and the Tenant should be aware and must accept the same.
3) Maintenance: Maintenance for central air-conditioning system, major electrical, plumbing and sanitary works of the Apartment and the Property are the responsibility of the Landlord. While any maintenance works inside the Apartment (like the replacement of shutoff pipe, showerhead, burnt bulbs, fused plugs etc.) are the responsibility of the tenant as these are caused by usage, and thus, should be borne by the tenant. This should be mentioned clearly in the contract to avoid any ambiguity, misunderstanding and conflict in the future.
4) Pet Policy: While some properties in Kuwait are pet-friendly and the Landlord allows the tenants to keep pets (Dogs, Cats, Birds etc.), most Landlords do not allow for the same. So tenants should be aware of this and it should be specifically mentioned in the lease contract whether it is a pet-friendly property or not. Q8REALTOR has many options for people looking for pet-friendly properties as per their requirements and budget range and can surely assist in finding the appropriate one matching their needs and preferences.
5) Parking: Many properties offer designated parking spots, whether in the basement, or outside shaded area in front of the building, for each tenant of the property. And it is mostly mentioned in the lease contract if that is the case. Many properties do not offer specific parking spots for each Apartment, and have a ‘First Come First Served’ policy. This should be confirmed before signing the lease contract to avoid any misunderstanding and conflict later on.
6) Facilities and Amenities: The facilities and amenities available in the property like Swimming Pool, Gym, Kids’ play area etc. are for the use of Tenants only. If the Tenants wish to invite their friends or associates to use these facilities, they have to seek permission from the Landlord and the Management for the same. They must also be prepared to bear the costs of any damages resulting from this.
7) Guest Visitation Policy: Certain properties may have rules and restrictions on guests visiting the tenants, especially bachelors and/or people not directly related to the tenants. While these rules and policies are mentioned in the lease contract at some places, at others they might just be informed orally to the tenants at the time of signing the lease contract. Tenants should take care to adhere to these policies in order to ensure not to attract any relevant penalties.
8) Vacating Notice: Most properties usually require a One Month written notice prior to vacating the Apartment. It should be a full Calendar Month notice (the notice should be given at the start of the month, rather than in the middle). Some may require more duration and it should be ensured that the same is mentioned in the lease contract, again for clarity and avoiding any issues later on.
9) Subleasing: Most Landlords do not allow subleasing the Apartment to a 3rd Party whose name is not mentioned in the lease contract. So this should be avoided as it will be considered breach of contract and can give grounds for immediate termination and any penalty as mentioned in the lease contract.
10)PACI Registration: The lease contract has to be registered with the Public Authority of Civil Information (PACI) in order to obtain the Kuwait Civil Id. Since March, 2026 PACI has introduced a Property Owner Approval requirement when registering a non-Kuwaiti residential address. Whenever any address registration is submitted, an instant notification is sent to the Property Owner in Sahel App. The Owner needs to approve the request before the process can be completed. It should be ensured that the Owner is ready to approve the request when it is sent to him via the Sahel App. Also, it should be ensured that valid copies of all the documents required from the Landlord like their Civil Id, Authorized Signatory document (‘Aithamad Taukiya’ in Arabic), property ownership document (‘Waseeka’ in Arabic) etc. are available, or will be provided eventually. Also, the address declaration form duly filled and signed by the tenant as well as the Landlord is required to be provided for registration of address.
